Given the urgent health situation that we are currently experiencing in connection with COVID-19,
the Government of Quebec yesterday ordered the closure of all non-essential businesses and
services, beginning Wednesday 25th March at 00:01 am and ending 13th April 2020.

Are the professional activities of the judicial officers of Quebec considered as essential?

The list of priority services and activities published by the Government of Quebec includes, under the heading Government Priority Services, "judicial and administrative tribunals, for matters they have deemed urgent" as well as "legal services".
The activities of judicial officers fall under "legal services".
Therefore, the following urgent procedures have already been identified as requiring the intervention of judicial officers as a matter of priority:

  • Any event that could lead to an injunction;
  • Injunctions, including those such as Anton Piller, Mareva and Norwich;
  • Seizures authorized by court judgement (art. 518, 519 C.p.c.);
  • Seizures authorized by the court on an emergency basis only;
  • Prior notice of proceedings in the context of hypothecary recourses;
  • Application to the Youth Division, among others, for child abuse;
  • Urgent proceedings for family matters;
  • Applications for involuntary commitment (psychiatric and other cases);
  • Lease renewal (current deadline March 31) and other urgent procedures from the Régie du logement;

Based on our understanding of the situation, only these procedures can be served and/or conducted at this time.
